About the Development Plan
Council has received an application for a development plan within an area covered by a planning overlay known as the 'Inverloch Growth Areas - Development Plan Overlay Schedule 24' area.
The applicant has provided all of the necessary information for Council to be able to review their application, however before we do, we want to know what you think.
What is a development plan?
A development plan, when endorsed, is a document that guides subsequent planning permit applications for development, uses and subdivisions. This means that any future planning permits need to align with the development plan.
A development plan outlines locations of potential elements such as residential development, accessways, vegetation and drainage locations.
Why is it needed?
A development plan must be considered and endorsed by Council before a subsequent planning permit is able to be granted, except in the case of a limited number of exemptions for minor applications.
The proposed development plan applies to the properties within Nesci Court as well as 1-4 / 70 Ullathornes Road.
Development plans are different from regular planning applications.
If Council endorses a development plan, it cannot be appealed to VCAT. Therefore, we encourage your feedback on the draft plan before a decision is made.
Once endorsed, the development plan will guide future planning permit applications for the land. These future applications can then be assessed and potentially approved by Council officers under delegated authority — without needing to go back to Council for a decision.
Importantly, any future development or use that aligns with the endorsed development plan will:
- Not require public notice, and
- Not be subject to appeal at VCAT.
